GAO identified four key areas where privacy risks have been identified:

1. An individual may be unaware that personally identifiable information will be collected about him or her in response to a request processed by the NAO.

2. Personally identifiable information may be collected, analyzed, or disseminated in a manner that makes the information inaccurate.

DHS claims these issues will be mitigated by “providing appropriate oversight” and by “building a process to identify and correct inaccurate information, and ensuring that the DHS Privacy Office and DHS Office for Civil Rights and Civil Liberties remain critical components of all review processes as new and improved technology is developed.”

In other words, we’re to rely on DHS to police itself and that agencies critical to Office operations such as the National Reconnaissance Office and the National Geospatial-Intelligence Agency will simply hand over America’s most closely-guarded intelligence secrets to federal civil rights attorneys for appropriate “oversight.” Talk about a blind leap into the darkness!

Let’s be clear here and shed whatever illusions one may have about the outcome of last Tuesday’s election. Despite the overwhelming rejection of the Bush administration and their surrogates by the American people, the incoming Obama administration will pay lip-service to civil liberties and the rule of law. This however, will amount to no more than a better public relations campaign, image management and product roll-out. America rebranded.

But as we have seen throughout the unfolding disaster that is the “war on terror,” the Democrats have been fully complicit with the crimes of the Bush regime. From the USA Patriot Act, warrantless wiretapping, immunity for criminal telecoms, “preemptive policing,” torture, financial fraud and the looting of the economy by capitalist grifters, not to mention the invasion and occupation of Afghanistan and Iraq, threats against Russia, China, Iran, Pakistan, Bolivia, Cuba and Venezuela–indeed any nation that doesn’t toe the imperialist line–the Democrats have been Bush’s most faithful and reliable partners.

While the GAO’s report is a welcome addition to the already voluminous catalogue of Bushist horrors, one can expect that NAO’s law enforcement “mission” will quickly–and quietly–come on line. After all there’s bundles of cash, courtesy of the American people, that need to be spread far and wide!

Since fatuously declaring his to be a “change” administration, President Barack Obama has quickly donned the blood-spattered mantle of state secrecy and executive privilege worn by the Bush regime.

On Friday April 3, the Department of Justice filed a motion to dismiss one of the Electronic Frontier Foundation’s (EFF) landmark lawsuits against illegal spying by the National Security Agency (NSA).

That suit, Jewell v. NSA, was filed last September against the NSA, NSA Director Keith B. Alexander, President George W. Bush, Vice President Richard Cheney, U.S. Attorney General Michael Mukasey and Mike McConnell, Director of National Intelligence. But with the departure of the Bush gang, the defendants now include President Barack Obama, NSA Director Keith B. Alexander, U.S. Attorney General Eric Holder and Dennis C. Blair, Director of National Intelligence.

When the suit was filed against the government, EFF declared:

The lawsuit, Jewel v. NSA, is aimed at ending the NSA’s dragnet surveillance of millions of ordinary Americans and holding accountable the government officials who illegally authorized it. Evidence in the case includes undisputed documents provided by former AT&T telecommunications technician Mark Klein showing AT&T has routed copies of Internet traffic to a secret room in San Francisco controlled by the NSA. Though the drapery in the Oval Office may have changed, the criminal acts against American citizens and legal residents by unaccountable intelligence agencies and privateers in the corporate security industry continue apace.

Based on information disclosed by AT&T whistleblower Klein and other sources, including The New York Times, the suit seeks to “halt illegal, unconstitutional, and ongoing dragnet surveillance” by AT&T and other grifting telecoms of the “communications and communications records” of their customers.

Klein told the Court in a sworn affidavit that AT&T’s internet traffic in San Francisco runs through fiber-optic cables at the company’s Folsom Street facility. Using a device known as a splitter, a complete copy of internet traffic that AT&T receives–email, web browsing requests and other electronic communications sent by AT&T customers, or received from people who use another internet service provider–was diverted onto a separate fiber-optic cable connected to the company’s SG-3 room, controlled by NSA. Only personnel with NSA clearances–either working for, or on behalf of the agency–have access to this room.

The evidence of corporate malfeasance presented by Klein and other whistleblowers, led the civil liberties’ watchdog group to assert that AT&T’s “deployment of NSA-controlled surveillance capability” is not limited to the corporation’s San Francisco facility “and is consistent with an overall national AT&T deployment to from 15 to 20 similar sites, possibly more. This implies that a substantial fraction, probably well over half, of AT&T’s purely domestic traffic was diverted to the NSA. At the same time, the equipment in the room is well suited to the capture and analysis of large volumes of data for purposes of surveillance.”

As I reported in November, among the firms supplying the surveillance products hardwired into America’s telecommunications infrastructure is Verint Systems Inc. (formerly Comverse InfoSys). The firm was founded by former Israeli intelligence officer, Jacob “Kobi” Alexander, a corporate grifter who fled the United States for Namibia after being indicted in 2006 on thirty-two counts of fraud. Alexander hatched a backdated stock options scheme that netted him $138 million in profits looted from company shareholders.

While Alexander and his family may be safely ensconced in the dry but relatively safe harbor of Windhoek, Verint’s security products live on, providing “actionable intelligence solutions” to repressors world wide. According to a Business Week company profile,

Verint Systems, Inc. provides analytic software-based solutions for the security and business intelligence markets. Its analytic solutions collect, retain, and analyze voice, fax, video, email, Internet, and data transmissions from voice, video and IP networks for the purpose of generating actionable intelligence for decision makers. The company primarily offers communications interception solutions, such as STAR-GATE, RELIANT, and VANTAGE; networked video solutions that include NEXTIVA; and contact center actionable intelligence solutions, which include ULTRA. Verint Systems serves government entities, global corporations, law enforcement agencies, financial institutions, transportation agencies, retail stores, utilities, and communications service providers. Other corporate outfits providing similar intelligence “solutions” to America’s telecommunications firms and agencies such as the CIA, FBI, Department of Homeland Security, Defense Intelligence Agency, National Reconnaissance Office and the National Geospatial-Intelligence Agency include Verint’s rival Narus (another spooky Israeli security firm), Siemans and Ericsson.

the economic meltdown, Washington Technology reported March 27 that “technology companies are poised to tap into the billions of dollars that will flow from the American Recovery and Reinvestment Act into new federal, state and local initiatives.” Many of the initiatives include new corporate welfare projects devised by the Department of Homeland Security and the FBI to “keep America safe.”

In this context, the Obama administration’s drive to preserve the NSA’s ability to illegally spy on Americans is intimately connected to the corporatist bottom line. After all, Democrat or Republican, the business of government is business.

Arguments in San Francisco federal district court by U.S. Attorneys have been described by constitutional law experts as being “worse than Bush.” In their motion to dismiss Jewell, the Obama administration cited the same perverse logic of the previous regime: that the state secrets privilege requires the court to dismiss the issue “out of hand.”

Douglas Letter, U.S. Terrorism Litigation Counsel for Obama’s Department of Justice, argued that simply allowing the case to proceed “would cause exceptionally grave harm to national security.”

Yet more pernicious–and unprecedented–arguments followed. “The DoJ,” according to EFF, now claim “that the U.S. Government is completely immune from litigation for illegal spying–that the Government can never be sued for surveillance that violates federal privacy statutes.”

Arguing that the state possesses “sovereign immunity,” the “change” administration now claims that under provisions of the disgraceful USA PATRIOT Act–a draconian law rammed through Congress in the wake of the 9/11 attacks–the state is “immune from suit under the two remaining key federal surveillance laws: the Wiretap Act and the Stored Communications Act.”

In practice, this means that under a new, ludicrous interpretation of the Orwellian PATRIOT Act, the government can never be held accountable for illegal surveillance under any federal statute. As Glenn Greenwald points out in Salon,

In other words, beyond even the outrageously broad “state secrets” privilege invented by the Bush administration and now embraced fully by the Obama administration, the Obama DOJ has now invented a brand new claim of government immunity, one which literally asserts that the U.S. Government is free to intercept all of your communications (calls, emails and the like) and–even if what they’re doing is blatantly illegal and they know it’s illegal–you are barred from suing them unless they “willfully disclose” to the public what they have learned. (“New and worse secrecy and immunity claims from the Obama DOJ,” Salon, April 6, 2009)

EFF attorney Kevin Bankston told Salon: “This is the first time [the DOJ] claimed sovereign immunity against Wiretap Act and Stored Communications Act claims. In other words, the administration is arguing that the U.S. can never be sued for spying that violates federal surveillance statutes, whether FISA, the Wiretap Act or the SCA.”

In their motion to dismiss, DoJ attorneys–like their predecessors–argue on Page 13 of the Government’s brief that “An assertion of the state secretes privilege “must be accorded the ‘utmost deference’ and the court’s review of the claim of privilege is narrow.” Kasza, 133 F.3d at 1166; see also Al-Haramain, 507 F3d at 1203 (‘[W]e acknowledge the need to defer to the Executive on matters of foreign policy and national security and surely cannot legitimately find ourselves second guessing the Executive in this arena’).”

On Page 16, the state contends that, “Finally, all of the plaintiffs’ claims require the disclosure of whether or not AT&T assisted the Government in alleged intelligence activities, and the DNI again has demonstrated that disclosure of whether the NSA has an intelligence relationship with a particular private company would also cause exceptional harm to national security–among other reasons by revealing to foreign adversaries which channels of communication may or may not be secure.”

If U.S. District Judge Judge Vaughn Walker rules in the state’s favor and dismisses Jewell, constitutional protections under the fourth amendment guaranteeing “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,” would be a meaningless charade.

There is however, a precedent for the Obama administration’s blatant violation of our rights: that of their predecessors in the Bush regime’s Office of Legal Counsel.

According to an October 23, 2001 Department of Justice memorandum titled Authority for Use of Military Force To Combat Terrorist Activities Within the United States, authored by torture-enabler and OLC head, John C. Yoo, the military could be deployed domestically to interrogate, detain, raid and spy on Americans, without having to comply with constitutional guarantees under the Bill of Rights. Yoo advised the Oval Office:

Fourth, we turn to the question whether the Fourth Amendment would apply to the use of the military domestically against foreign terrorists. Although the situation is novel (at least in the nation’s recent experience), we think that the better view is that the Fourth Amendment would not apply in these circumstances. Thus, for example, we do not think that a military commander carrying out a raid on a terrorist cell would be required to demonstrate probable cause or to obtain a warrant. (Page 2)

Additionally, having decided that the President enjoys plenary, that is, unlimited power to carry out the “war on terror” Yoo concludes, after dispensing with Fourth Amendment protections that,

First Amendment speech and press rights may also be subordinated to the overriding need to wage war successfully. …

The current campaign against terrorism may require even broader exercises of federal power domestically. Indeed, the Bush administration’s so-called Terrorist Surveillance Program (TSP) transformed the United States into a limitless battlespace where anything goes. From warrantless wiretapping of telephone and internet communications, the seizure of business and medical records, as well as the illegal–and indefinite–detention of citizens and legal residents as “unlawful enemy combatants,” Yoo’s memorandum provided the steel and concrete that gave form to the architectural blueprints for a presidential dictatorship.

Instructively, these memos were not withdrawn until 2008. However, in moving to suppress Jewell, Obama’s Justice Department and their private partners in the telecommunications industry in practice, are continuing the same repressive policies.

As Wired reported back in January, “NSA whistleblower Russell Tice” revealed “that the National Security Agency spied on individual U.S. journalists, entire U.S. news agencies as well as ‘tens of thousands’ of other Americans.”

Tice said on Wednesday that the NSA had vacuumed in all domestic communications of Americans, including, faxes, phone calls and network traffic.

Today Tice said that the spy agency also combined information from phone wiretaps with data that was mined from credit card and other financial records. He said information of tens of thousands of U.S. citizens is now in digital databases warehoused at the NSA.

“This [information] could sit there for ten years and then potentially it marries up with something else and ten years from now they get put on a no-fly list and they, of course, won’t have a clue why,” Tice said.

As George Washington University Law Professor and constitutional scholar, Jonathan Turley, told MSNBC’s Keith Olbermann on “Countdown” April 7,

I think right now, the Bush people are bringing out their mission-accomplished sign, because they’ve not only gotten Obama to protect Bush and Cheney and others from any criminal investigation on torture, but he’s now gone even further than they did in the protection of unlawful surveillance. This is the ultimate victory for the Bush officials. They have Barack Obama adopting the same extremist arguments, and in fact exceeding the extremist arguments made by President Bush…

You cannot any longer suggest that President Obama is advancing the civil liberties and the privacy interests that he promised to advance. This is a terrible roll-back. It’s a terrible decision. (“Countdown” with Keith Olbermann, MSNBC, Tuesday, April 7, 2009)

And with Congress’ passage of the abominable FISA Amendments Act (FAA) last July, handing the NSA carte blanche to continue warrantless spying and driftnet surveillance of Americans, granting grifting telecom giants such as AT&T, Sprint and Verizon get-out-of-jail-free-cards in the form of retroactive immunity for their collusive and wholly illegal activity with NSA and other state agencies, America’s post-constitutional new order continues apace. As I reported last September, “the extent of these illegal programs have revealed, the ‘enemy’ is none other than the American people themselves!”

Three months into the Obama administration, the contours of a new and improved “liberal” police state reveal the same rotten, nidorous core as that of their predecessors. This time around however, the mailed fist of the capitalist state is gussied up with Smiley Face emblems and Hello Kitty stickers.

A declassified CIA document dated 7 January 1953 [1] with a section heading "Outline of Special H Cases" describes the creation of multiple personality in two 19-year old girls. "H" is shorthand for hypnotic, hypnotized, or hypnotism in these documents: "These subjects have clearly demonstrated that they can pass from a fully awake state to a deep H controlled state ... by telephone, by receiving written matter, or by the use of code, signal, or words and that control of those hypnotized can be passed from one individual to another without great difficulty. It has also been shown by experimentation with these girls that they can act as unwilling couriers for information purposes." BB 32

After the end of World War II, German scientists were being held in a variety of detainment camps by the allies. In 1946, President Truman authorized Project Paperclip [2][3][4] to exploit German scientists for American research, and to deny these intellectual resources to the Soviet Union. Some reports bluntly pointed out that they were "ardent Nazis." They were considered so vital to the "Cold War" effort, that they would be brought into the US and Canada. Some of these experts participated in murderous medical experiments on human subjects at concentration camps. A 1999 report to the Senate and the House said "between 1945 and 1955, 765 scientists, engineers, and technicians were brought to the US under Paperclip and similar programs." [5] BB 3, NB xi, xii

According to the Central Intelligence Agency's Fact Book, [6] the NSC (National Security Council) and the CIA were established under the provisions of the National Security Act of 1947. In December 1947, the NSC held its first meeting. James Forrestal, the Secretary of Defense, pushed for the CIA to begin a 'secret war' against the Soviets. Forrestal's initiative led to the execution of psychological warfare operations (psy-ops) in Europe. CIA personnel were not opposed to working with Nazi doctors who had proven to be proficient in breaking the mind and rebuilding it. In some cases military bases were used to hide these covert activities. It was decided that the communist threat was an issue that took priority over constitutional rights. MC 1, 3, 7, 8, NB xvii

The concept of running a secret 'black' project was no longer novel. In 1941, Roosevelt had decided, without consulting Congress, that the US should proceed with the utmost secrecy to develop an atomic bomb. Secrecy shrouded the Manhattan Project (the atomic bomb program) to the extent that Vice President Harry Truman knew nothing about it. [7] The project meant that by 1947, the US Government had already gained vast experience in the initiation of secret operations. The existence of 'black projects' funded by 'black budgets' was withheld not only from the public, but also from Congress for reasons of national security. MC 8-10

A declassified CIA document [8] "Hypnotic Experimentation and Research, 10 February 1954" describes a simulation of relevance to the creation of unsuspecting assassins: "Miss [deleted] was instructed (having previously expressed a fear of firearms in any fashion) that she would use every method at her disposal to awaken Miss [deleted] (now in a deep hypnotic sleep) and failing this, she would pick up a pistol nearby and fire it at Miss [deleted]. She was instructed that her rage would be so great that she would not hesitate to "kill" [deleted] for failing to awaken. Miss [deleted] carried out these suggestions to the letter including firing the (unloaded) gun at [deleted] and then proceeding to fall into a deep sleep. Both were awakened and expressed complete amnesia for the entire sequence. Miss [deleted] was again handed the gun, which she refused (in an awakened state) to pick up or accept from the operator. One of the areas to be investigated by the CIA was mind control. The CIA's human behavior control program was chiefly motivated by perceived Soviet, Chinese, and North Korean use of mind control techniques. Under the protection of 'national security,' many other branches of the government also took part in the study of this area. The CIA originated its first program in 1950 under the name BLUEBIRD, which in 1951, after Canada and Britain had been included, was changed to ARTICHOKE. MKULTRA officially began in 1953. The CIA Mind Control Projects

Project BLUEBIRD was approved by the director of the CIA on April 20, 1950. In a 1951 memo, [11] Bluebird states that practical research was to be conducted to include these specific problems:
•Can we create by post-H [hypnotic] control an action contrary to an individual's basic moral principles?
•Can we in a matter of an hour, two hours, one day, etc., induce an H condition in an unwilling subject to such an extent that he will perform an act for our benefit?
•Could we seize a subject and in the space of an hour or two by post-H control have him crash an airplane, wreck a train, etc.?
•Can we by H and SI [sleep inducing] techniques force a subject to travel long distances, commit specified acts and return to us or bring documents or materials?
•Can we guarantee total amnesia under any and all conditions?
•Can we "alter" a person's personality?
•Can we devise a system for making unwilling subjects into willing agents and then transfer that control to untrained agency agents in the field by use of codes or identifying signs?

Officially, MKULTRA was established on 13 April 1953, at Richard Helms' suggestion as "ultra sensitive" work. The program requires the services of highly specialized authorities in many fields of natural science. The concepts involved in manipulating human behavior are found by many people both within and outside the Agency to be distasteful and unethical. Nevertheless, there have been major accomplishments both in research and operational employment.

Over the ten-year life of the program many additional avenues to the control of human behavior have been designated under the MKULTRA charter, including radiation, electro-shock, harassment substances, and paramilitary devices. Some MKULTRA activities raise questions of legality implicit in the original charter. A final phase of the testing of MKULTRA products places the rights and interests of US citizens in jeopardy. Public disclosure of some aspects of MKULTRA activity could induce serious adverse reaction in US public opinion.

TSD [Technical Services Division of CIA] initiated a program for covert testing of materials on unwitting US citizens in 1955. TSD has pursued a philosophy of minimum documentation in keeping with the high sensitivity of some of the projects. Some files contained little or no data at all. There are just two individuals in TSD who have full substantive knowledge of the program and most of that knowledge is unrecorded. In protecting the sensitive nature of the American intelligence capability to manipulate human behavior, they apply "need to know" doctrine to their professional associates.

The CIA bought my services from my grandfather in 1952 starting at the tender age of four. [20] Over the next 12 years, I was tested, trained, and used in various ways. The basic premise of the book The Manchurian Candidate [22] is that a group of American POWs in the Korean War is brainwashed while crossing through Manchuria to freedom. In an experiment described in a document entitled "SI and H experimentation [23] (25 September 1951)," two female subjects took part in an exercise involving the planting of a bomb. Both subjects performed perfectly and were fully amnesic for the exercise: "[Deleted] was instructed that upon awakening, she would proceed to [deleted] room where she would wait at the desk for a telephone call. The Mind Control Doctors

In the second half of the 20th century, mind control projects resulted in extensive political abuse of psychiatry in North America. The MKULTRA contractor about whom the most has been written is Dr. Ewen Cameron. [31][32][33][34][35] At various times, Dr. Cameron was President of the American, Canadian, and World Psychiatric Associations. He was one of four co-founders of the World Psychiatric Association. From January 1957 until September 1960, Dr. Cameron's project received $64,242.44 in CIA funds. Jose Delgado's development of the Stimoceiver in the 1950s brought intelligence agencies' ultimate dream of controlling human behavior one step closer to reality. The Stimoceiver–a miniature electrode capable of receiving and transmitting electronic signals–could be placed within an individual's cranium. Brain electrode research was also conducted independently at Harvard by Dr. Delgado's coauthors, Drs. Vernon Mark, Frank Ervin, and William Sweet. Mark and Ervin describe implanting brain electrodes in a large number of patients at Harvard hospitals. A patient named Jennie was 14 years old when they put electrodes in her brain. Non-Lethal Weapons

Non-lethal weapons is a broad category which includes devices for beaming various kinds of energy at human targets in order to temporarily incapacitate them, or to control or affect their behavior. Non-lethal weapons research has been conducted at universities on contract to the CIA, and has overlapped with research on hallucinogens and brain electrode implants. BB 103

In 1991, Janet Morris, one of the main proponents of non-lethal weapons, issued a number of papers. [71] According one paper, US Special Operations Command already had a portable microwave weapon. "US Special Forces can cook internal organs." [72] Another concept was 'Infrasound' using acoustic beams. Laboratories were developing a high power, very low frequency acoustic beam weapon projecting non-penetrating acoustic bullets. Already, some governments have used infrasound as a means of crowd control. Very low frequency (VLF) sound, or low frequency RF modulations can cause nausea, vomiting and abdominal pains. "Some very low frequency sound generators can cause the disruption of human organs and, at high power levels, can crumble masonry." [73] MC 176-179

Funding of these experiments began in MKULTRA. Subproject 62 documents "certain kinds of radio frequency energy have been found to effect reversible neurological changes in chimpanzees." [74] Subproject 54 was studying how to produce concussions from a distance using mechanical blast waves propagated through the air. Such a concussion "is always followed by amnesia for the actual moment of the accident." It states: "The blast duration would be in the order of a tenth of a second. Masking of a noise of this duration should not be difficult. It would be advantageous to establish the effectiveness of both of the above methods as a tool in brain-wash therapy." BB 103-105

A confidential report prepared by the US Army as early as 1969 detailed the effect an infra-sonic system would have on humans. These effects range from disruption of nervous systems to death. [75] MC 199, 200

That such weapons have been used can be in little doubt. When the deployment of Cruise missiles at American bases in the UK was at its height, women peace campaigners staged a series of highly publicized peaceful protests outside the perimeter wires. In late 1985, the women in the peace camps at Greenham Common began to experience unusual patterns of illness, ranging from severe headaches, drowsiness, menstrual bleeding at abnormal times or after the onset of menopause, to bouts of temporary paralysis and faulty speech coordination. Electronics Today [76] magazine carried out a number of measurements, and in December 1985 published their report which concluded: "Readings taken with a wide range of signal strength meters showed marked increases in the background signal level near one of the women's camps at a time when they claimed to be experiencing ill effects." They noted that if the women created noise or a disturbance near the fence, the signals rose sharply. MC 201

The evidence in hand suggests that the technology to produce 'voices in the head' does exist. The Department of Defense has already acquired the technology to alter consciousness through various projects and programs. A patent discusses methods and system for altering consciousness. The abstract from once such program states: "Researchers have devised a variety of systems for stimulating the brain to exhibit specific brain wave rhythms and thereby alter the state of consciousness of the individual subject." [77] Silent subliminal messages [were] "used throughout Operation Desert Storm (Iraq) quite successfully." [78] MC 203, 204

A US State Department report suggested it was possible to induce a heart attack in a person from a distance with radar. [79] MC 172

By 1974, Stanford Research Institute had developed a computer system capable of reading a person's mind by correlating the brain waves of subjects on an electroencephalograph with specific commands. [80] The concept of mind-reading computers is no longer science fiction. Neither is their use by Big Brotherly governments. Major Edward Dames of Psi-Tech said in April 1995 on NBC's The Other Side program: "The US government has an electronic device which could implant thoughts in people." Dames would not comment any further. MC 172

The latest development in the technology of induced fear and mind control is the cloning of the human EEG or brain waves of any targeted victim, or indeed groups. With the use of powerful computers, segments of human emotions which include anger, anxiety, sadness, fear, embarrassment, jealousy, resentment, shame, and terror, have been identified and isolated within the EEG signals as 'emotion signature clusters.' Their relevant frequencies and amplitudes have been measured. Then the very frequency/amplitude cluster is synthesized and stored on another computer. Each one of these negative emotions is separately tagged. They are then placed on the Silent Sound carrier frequencies and could silently trigger the occurrence of the same basic emotion in another human being. MC 205
